The object of this suit is to enforce the lien of the Complainant, County of Dickenson, Virginia, for delinquent real estate taxes against certain real property located in the County of Dickenson, Virginia, described as follows:

All that certain tract, piece or parcel of land, situate, lying ad being in the Ervinton Magisterial District of Dickenson County, Virginia, on Sandry Ridge, on what is known as the Flap Spur Road ( Route 653), this being more particularly bounded and descried as follows:

Beginning at a stake in the East side of Route 658 and a corner of the line of lands now or formerly owned by Burnie William Heaton; thence with the right of way of said road N 14 E 170 feet to a stake in said right of way; thence with said right of way N 23 W 125 to a stake; thence with said right of way N 21 E 140 feet to a stake; thence leaving said road N 90 E 94 feet to a stake; thence N 45 E 165 feet to a maple, a corner of the line of lands now or formerly owned by Vearl Phillips, S 55 E 475 feet to a sassafras; thence with Vearl Phillips line S 15 W 220 feet to a stake and corner in the line of lands now or formerly owned by Maynard Fred Heaton; thence S 57 W 545 feet along the Maynard Fred Heaton line to the beginning, containing three acres, more or less.

Being the same property conveyed to Maynard Fred Heaton and Sandra Kay Heaton, his wife with the right of survivorship, by Deed from Burnie William Heaton and Tunnia Bell Heaton, dated April 20, 1970 and recorded among the land records of the Circuit Court of Dickenson County, Virginia on May 5, 1970 in Deed Book 145 at Page 240.

This description is made subject to all easements, conditions, agreements, restrictions, and reservations of record which affect the property herein described.

All that certain lot, piece or parcel of land, situate, lying and being in the Ervinton Magisterial District of Dickenson County, Virginia, containing 8.0 acres, more or less, and being more particularly known among the tax rolls of Dickenson County as Tax Map Number 03583 and Account Number 10346.

Being the same property conveyed to Kay Heaton by the Last Will and Testament of Gracie Dorcas Rasnick, dated May 17, 1991 and recorded among the land records of the Circuit Court of Dickenson County, Virginia in Will Book 308 at Page 534.

This description is made subject to all easements, conditions, agreements, restrictions, and reservations of record which affect the property herein described.

IT APPEARING that an Affidavit has been made and filed stating that due diligence has been used, without effect, to ascertain the identity and location of certain parties to be served, that the last known addresses for the Respondents herein are as follows: Maynard Fred Heaton, who is believed to be deceased and whose last known address is unknown; Sandra Kay Heaton also known as Kay Heaton, who is believed to be deceased and whose last known address is unknown; Martin Heaton AKA Marty Heaton # 10825734, who last known address is SWVA Regional Jail Authority Haysi, 1550 Kiwanis Park, Haysi, Virginia 24256 and who is incarcerated; and that any officers, heirs, devisees, and successors in title of the Respondent named herein are made parties Respondent to this action individually and/or by the general description of Parties Unknown, it is hereby

ORDERED that the parties herein and all Parties Unknown and/or whose location cannot be ascertained appear on or before August 7, 2026 in the Clerk’s Office of the Circuit Court of the County of Dickenson, Virginia, and do what may be necessary to protect their interests in this cause.
